These Terms and Conditions (“Terms”) govern access to and use of websites, digital platforms and online services operated by SEAM Agency, including seamagency.co.za and seamco.app.
By accessing or using these services, you agree to these Terms.
If you enter into a separate proposal, service-level agreement, retainer agreement, WIL agreement, host agreement, education partnership, subscription agreement or other written contract with SEAM, that agreement will govern the specific relationship and will take precedence where there is a conflict with these general website Terms.
1. About SEAM
SEAM Agency is a South African creative agency providing services including strategy, communications, content, design, digital marketing, partnerships and creative-development initiatives. SEAM also operates seamco.app and the SEAM Creative Network, which support connections between creatives, brands, host organisations, mentors, education partners and industry opportunities.
2. Website and Platform Use
You may use SEAM websites and platforms only for lawful purposes.
You agree not to:
gain unauthorised access to accounts or systems;
interfere with website or platform security;
upload malicious software;
impersonate another person or organisation;
submit intentionally false or misleading information;
scrape or extract platform information without authorisation;
misuse another user’s personal information;
infringe intellectual-property rights;
use SEAM platforms for unlawful, fraudulent or abusive activity; or
interfere with the normal operation of the platform.
We may restrict or suspend access where we reasonably believe these Terms have been breached or where doing so is necessary to protect SEAM, its users or its systems.
3. Accounts on seamco.app
Certain services may require you to create an account.
You are responsible for:
providing accurate information;
maintaining the accuracy of your profile;
protecting your login credentials;
activity conducted through your account; and
notifying SEAM if you become aware of unauthorised access.
SEAM may request additional information or verification before enabling certain platform functions.
4. SEAM Creative Network and WIL
Participation in the SEAM Creative Network or a WIL programme does not automatically guarantee:
placement with a particular organisation;
completion of academic requirements;
employment;
freelance work;
payment;
an internship;
future work opportunities; or
any specific commercial outcome.
Placements depend on factors including suitability, availability, education requirements, host capacity and programme conditions. Students remain responsible for meeting the academic requirements imposed by their education institution.
Host organisations, mentors, education partners and participating organisations may be subject to additional agreements defining their respective responsibilities.
SEAM facilitates and administers aspects of these relationships but does not automatically become the employer of a student, creative or participant merely because they use the platform or participate in a programme.
5. Project and Service Enquiries
Submitting an enquiry through seamagency.co.za or seamco.app does not create a binding service agreement.
A project becomes binding only once the relevant scope, pricing, deliverables and terms have been agreed through an accepted proposal, contract, service-level agreement or other written confirmation. Prices displayed online may be indicative unless expressly stated otherwise.
6. Payments, Subscriptions and Bookings
Where SEAM offers paid services, bookings, packages or subscriptions, additional pricing and payment terms may be displayed during the relevant transaction. You are responsible for reviewing those terms before making payment.
Any cancellation, renewal or refund terms applicable to a particular service will be communicated as part of that service or agreement.
Nothing in these Terms is intended to limit rights that cannot lawfully be excluded under applicable South African consumer law. The Consumer Protection Act establishes standards for consumer information and fair consumer transactions where it applies.
7. Intellectual Property
Unless otherwise stated, the SEAM name, identity, websites, platform design, written content, graphics, systems, templates and other materials created by SEAM are owned by or licensed to SEAM. They may not be reproduced, distributed, sold, altered or commercially exploited without permission.
Specific intellectual-property rights relating to client work and project deliverables will be governed by the applicable client agreement.
8. User and Portfolio Content
You retain ownership of original content that you submit to SEAM, including portfolio work, images, documents and profile information, subject to any rights owned by third parties.
By submitting content for use on seamco.app, you grant SEAM a limited permission to store, process and display that content to the extent reasonably necessary to operate the service or fulfil the purpose for which it was submitted.
For example, portfolio material submitted as part of a creative profile may be displayed through that profile or shared with relevant parties where the user has chosen to participate in an application or opportunity. You should only upload material that you have the legal right to submit.
9. Confidential Information
Users may encounter confidential information relating to brands, creative projects, students, clients, partners or other users. You must not disclose confidential information obtained through SEAM except where authorised or legally required.
Separate confidentiality obligations may also apply under project, WIL, host, client or partnership agreements.
10. Third-Party Services
SEAM may integrate with or link to external platforms, payment services, cloud systems, communication tools or other third-party services. Third-party services are governed by their own terms and policies.
SEAM is not responsible for the independent operation of third-party platforms outside its reasonable control.
11. Platform Availability
We aim to keep SEAM websites and services accessible and operational, but availability cannot be guaranteed at all times. Maintenance, technical problems, service-provider failures, updates, security incidents or other circumstances may result in interruptions.
We may modify, add or remove platform functionality as SEAM develops.
12. Information on the Website
SEAM aims to keep website and platform information accurate and current.
However, general website content is provided for informational purposes and should not be treated as professional legal, financial or other regulated advice. Project-specific commitments must be confirmed in writing.
13. Limitation of Liability
To the fullest extent permitted by applicable law, SEAM will not be responsible for indirect or consequential losses resulting solely from use of, or inability to use, its websites or platforms.
This does not exclude liability that cannot lawfully be excluded or restricted.
Users remain responsible for decisions they make based on information or opportunities accessed through the platform.
14. Termination or Suspension
SEAM may suspend or terminate access where:
these Terms are materially breached;
the platform is being misused;
payment obligations remain outstanding where applicable;
continued access presents a security or legal risk; or
an account must be closed in accordance with another agreement.
Users may request closure of their accounts subject to outstanding obligations and applicable record-retention requirements.
15. Privacy
Use of SEAM websites and platforms is also subject to the SEAM Privacy Policy.
The Privacy Policy explains how personal information is processed across seamagency.co.za, seamco.app and SEAM Creative Network programmes.
16. Electronic Communications
By interacting with SEAM electronically, you acknowledge that communications, notices and agreements may where legally permissible be concluded or delivered electronically.
South Africa’s Electronic Communications and Transactions Act provides a legal framework for electronic communications and transactions.
17. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved between the parties will be dealt with in accordance with applicable South African law and any dispute-resolution mechanism contained in a separate agreement between the parties.
18. Changes to These Terms
SEAM may update these Terms as the business, platform and services evolve. The updated version will be published with a new effective date. Continued use of the services after an update will be subject to the revised Terms where legally permissible.
